The Post-COVID Lawyer in the Digital Age
As a lawyer who has witnessed firsthand the transformative effects of the digital age and the COVID-19 pandemic on our profession, I am excited to share my insights on these changes and the future of legal practice. In my practice, I predominantly function onsite, but I have found substantial value in the hybrid model, particularly during virtual court sessions. One of the most intriguing aspects of conducting trials remotely is the enhanced capability to observe witness reactions up close during cross-examinations. The virtual environment allows me to see facial expressions and nuances more clearly than in a traditional courtroom setting. This visibility is a powerful tool, helping me gauge the sincerity and credibility of a witness more effectively.
Neutralizing the Power Imbalance
In addition, Family Law cases brought to court often deal with abusive and violent relationships. In a courtroom, you can often see the fear and anxiety that comes with a victim of abuse having to take the stand and face their abuser. The effect of having an abuser in close proximity can make a victim feel like there is an imbalance of power. Over a virtual setting, this imbalance of power is largely neutralized. Neither party is physically dominating the hearing due to the physical separation. This can alleviate stress, and create the feeling of a safer environment.
The Future of Legal Operations
It’s my opinion that the future of law office operations will increasingly adopt a hybrid model. It combines the flexibility of remote work, which can boost efficiency and balance personal demands, with the necessity of in-person interactions that are crucial for certain aspects of legal practice. This model not only caters to logistical preferences but also enhances the tactical execution of legal procedures like cross-examinations, where direct visual engagement can be pivotal.
I advocate for this hybrid approach because it represents the best of both worlds. It provides the adaptability required in modern legal practice while maintaining the rigorous standards of courtroom decorum and interaction essential for justice to be effectively administered.
